Overview
Diversity X (hereinafter “Diversity X”, “we”, “our” or “us”), is the licensed trading name of Overlooked and Underestimated CIC, a private limited company registered in England and Wales, registered number 14903594 with registered office, Heritage House, Newton Road, Sudbury, England, CO10 2RL, is a worldwide network of underestimated founders (the “Network”) with the primary focus of encouraging members to connect, learn, and build sustainable businesses.

Diversity X owns, operates and makes available the website https://www.diversityx.vc/ as well as subdomain websites to users of these websites (collectively referred to as the “Website”) under the following Terms and Conditions.

Access to Diversity X’s services is available via memberships. Users of Diversity X’s website who have purchased a membership, whether it is free or not, are collectively referred to as a “Members” or individually as “Member”. “Membership” means any of the memberships proposed on our Website. Users who have subscribed to Diversity X’s newsletter are referred to collectively as “Subscribers” or individually as a “Subscriber”. “Users[w1] ” means any person who either browses the Diversity X’s website, and/or speaks with our employees and staff members, and/or creates a profile to log on the Website, and/or accesses our services available without becoming a Member.
1.1 Use of our Website includes:
a. accessing or browsing our Website;
b. registering to become a Member through our Website;
c. searching for information and downloading reports through our Website.
1.2 The Privacy Policy, which sets out the terms on which we process any personal data we collect from you or that you provide to us, also applies to your use of our Website and the Network. By using our Website, you consent to such processing and you warrant that all data provided by you is both lawfully disclosed and accurate.
2. Agreement to the Terms and Conditions
The Website may contain features including blog, report and newsletter services; event, issue and community pages; Member areas and other applications that may be available from time to time. Any person who accesses or uses the Website agrees to be bound by these Terms and Conditions, which include conditions, disclaimers and other provisions, some of which limit or exclude Diversity X’s liability. Any person who does not agree or comply with these Terms and Conditions should not access or use the Website.
3. Age Requirement for our Members and Subscribers
3.1 You must not use Diversity X, become a Member or a Subscriber of Diversity X unless you are aged 18 or older. If you are under 18 and you become a Member or a Subscriber of Diversity X by lying about your age, or are otherwise in breach of our Terms and Conditions for our Site, you must immediately stop using Diversity X and terminate your Membership and unsubscribe from our newsletter.
3.2 This Website is not intended for children, and we do not knowingly collect data relating to children.
4. Changes to the Terms and Conditions
These Terms and Conditions may be amended by us from time to time by updating this page. The date of the latest version of these Terms and Conditions is written at the end of the Terms and Conditions. Your continued use of the Website following the posting of any changes to these Terms and Conditions constitutes acceptance of those changes.
5. Membership
5.1 If you want to make use of the facilities available through our Memberships, you must first register as a Member. Attendance of some Diversity X events, for example, is restricted to certain Memberships.
5.2 During registration, you will be asked to provide your name and email address, details of your current roles and the companies for which you work, and other information which is listed in our Privacy Policy.
5.3 You will be responsible for all activities arising out of your Membership. It is your responsibility immediately to notify us of any unauthorised use of your Membership or any other breach of security as soon as you become aware of it.
5.4 By registering, you warrant that all information you provide in the registration is accurate and you will inform us immediately of any changes to the information that you provided when registering.
5.5 We reserve the right not to proceed with, or to cancel, your application to become a Member for any reasonable reason.
5.6 Members must comply with these Terms and Conditions and further acknowledge that, in addition to any rights that we have, any breach of these Terms and Conditions will entitle us, in our reasonable discretion, to terminate Membership immediately and without notice.
6. Access to platform and changes to our platform
6.1 We do not guarantee that our Website, or any content in it, will always be available or uninterrupted. We reserve the right (in our sole discretion) to suspend, withdraw or restrict the availability of the Website (or part thereof) for business and operational reasons.
6.2 We do not guarantee that our Website, or any content in it, will always be free from errors or omissions.
6.3 We make reasonable commercial efforts to update the information on the Website. However, we do not provide any representations, warranties or guarantees that any information on our Website is up-to-date.
7. Appropriate Use
You may not use the Website in any way that would limit or constrict the availability or quality of the Website’s features .
You may only use our Network for lawful purposes. You may not use our Network:
7.1 In any way that breaches any applicable local, national or international law or regulation,
7.2. In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect,
7.3 For the purpose of harming or attempting to harm minors in any way,
7.4 To transmit, or procure the sending of, any unsolicited or unauthorised advertising, promotional materials, solicitation of funds, spam, chain letter, junk mail or any other form of similar solicitation for goods or services except in those areas that are clearly designated for such purpose,
7.5 To transmit viruses or any other code, files or programs designed to damage, interrupt, destroy or limit the functionality of any computer software, hardware or telecommunications equipment,
7.6 In any way that infringes any patent, trademark, database right, trade secret, copyright or other proprietary right of any party,
You also agree:
7.7 to show respect for other Members.
7.8 not to interfere with another Member’s use or enjoyment of the Diversity X Website.
7.9 not to use, reproduce, duplicate, copy or re-sell any part of the Network or any materials obtained through the Website without our prior written consent.
8. Third party links
8.1 The Website contains links to third party websites. Such links are provided for your convenience only. We do not control such websites and are not responsible for their contents. We do not check and are not responsible for the accuracy, completeness or truth of third party websites. If you decide to access any of the third party websites linked to from this Website, you do so entirely at your own risk.
8.2 The mere inclusion of such links does not imply any endorsement of the material on those websites or any association with their operators. This material is provided ‘as is’, without us giving any representations, conditions, warranties or other Terms and Conditions of any kind.
8.3 We cannot guarantee that these links will work all the time and we have no control over the availability of the linked pages. Users should seek appropriate advice before taking or refraining from taking any action in reliance on any information contained in such third party websites.
9. Information shared amongst Members
9.1 Members may chose to share information with other Members or another Member. Diversity X does not control such information and are not responsible for the content of such information. Diversity X do not check the information and cannot guarantee the accuracy of such information.
9.2 The availability of such information does not imply any endorsement of the material by Diversity X. If you decide to use such information, you do so at your own risk. Users should take advice before taking or refraining from taking any action in reliance on any information contained in such information.
10. Limitation of liability
10.1 We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
10.1.1 use of, or inability to use, our Website; or
10.1.2 use of or reliance on any content displayed on our Website including, without limitation, Diversity X’s toolkits and guides.
10.2 In particular, we will not be liable for:
10.2.1 loss of profits, sales, business, or revenue;
10.2.2 business interruption;
10.2.3 loss of anticipated savings;
10.2.4 loss of business opportunity, goodwill or reputation; or
10.2.5 any indirect or consequential loss or damage.
10.3 We exclude all implied conditions, warranties, representations or other implied terms that may apply to our Website or any content on it.
10.4 Nothing in these Terms and Conditions shall be construed as excluding or limiting our liability for: (i) death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors, (ii) fraud or fraudulent misrepresentation, or (iii) any liability which cannot be excluded or limited under applicable law.
11. Electronic communications
When you visit the Website or send e-mails to us, you are communicating with us electronically. We communicate with you by e-mail or by posting notices on the Website. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
12. Site Content and Member Content Standard
All materials displayed or performed on the Diversity X Website (including, but not limited to text, graphics, photographs, images, illustrations and video clips) are protected by database rights and other intellectual property rights, which are owned or controlled by us or our third-party content providers. You may not sell, reproduce, modify, copy, distribute or use for any commercial purpose any such materials without our written consent.
13. Waiver and severability of Terms and Conditions
The failure of Diversity X to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. If any provision in these Terms and Conditions is found by a court of competent jurisdiction to be invalid, illegal or unenforceable, the parties nevertheless agree that the court should endeavour to give effect to the parties’ intention as reflected in this provision and that such provision shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted and the remainder of these Terms and Conditions shall remain in full force and effect.
14. Events beyond our control
We will not be liable to you for any delay in delivering any services or order or breach of our obligations, if the delay or breach is due to acts of God, civil commotion, riots, malicious damage, floods, drought, fire, legislation, failure of ISP or telecommunications provider or other cause beyond our reasonable control. This does not affect your statutory rights.
15. Applicable laws
These Terms and Conditions, their subject matter and their formation (and any non-contractual disputes or claims) are governed by the laws of England and Wales. We and all persons using our website hereby irrevocably agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms and Conditions or its subject matter or formation (including non-contractual disputes or claims).

16. Job Posting Terms
16.1 What our service provides:
We will post your job advert on Diversity X’s job board within 48 working hours of receipt.
Your listings appear:
in our newsletter and
on our App job board.
Your listings will also appear in each selected community
Your listings will appear for a period of 12 weeks, with a possible renewal for an extra 4 weeks. For anything longer, please contact kevin@diversityx.vc.
Listings appear in chronological order, with the most recent listing at the top of the list.
16.2 Mode of communication

Please indicate in which community you would like your listings to appear.
Please submit all listings in basic MS Word or plain text format – PLEASE NOTHING FANCY and NO PDFs.
Please clearly indicate the location(s) of the role and how candidates should apply, including an email address or URL.
We would like to encourage you to reply to the candidates within 3 working days.
